State of Tennessee v. Dallas Wayne Tomes, Jr. - Concurring Opinion

I concur in the majority’s conclusions that the trial court did not err in denying the
Defendant’s motion to dismiss and in classifying him as a career offender. I write
separately to address my departure from the majority’s analysis on the standard of review
to be employed for the sentencing range determination issue.
