Order of the Supreme Court dated August 23, 2011:

It is Ordered that Mr. Watkins and Mr. Cross are directed to brief the issues concerning Double Jeopardy.  Mr. White is directed to brief the issues concerning Due Process.  Mr. Watkins, Mr. White, and Mr. Cross shall file their supplemental briefs no later than September 22, 2011.  The State of Tennessee shall file a single supplemental response brief thirty days after the defendants' briefs are filed, but in no event later than October 22, 2011.  Consolidated re-argument of these appeals is scheduled for November 1, 2011, at 3:30 p.m. in Nashville.  Each side (the defendants collectively and the State) shall receive forty-five minutes of argument time, for a total of one and one-half hours of argument for all three appeals.  The Court invites the Tennessee Bar Association, the Tennessee Association of Criminal Defense Lawyers, the Tennessee District Public Defenders Conference, and the Tennessee District Attorneys General Conference to submit amicus curiae briefs addressing any or all of the issues enumerated in the order, with the deadline for filing an amicus curiae brief of September 30, 2011.  Other interested organizations may also seek leave of this Court to file amicus curiae briefs.  None of the amicus curiae may participate in oral argument unless a party agrees to share its allotted time.
