Cases Description

The case centered on the legality of Torch's "No Chance Games" (NCGs) in relation to Tennessee's criminal gambling statutes (Tenn. Code Ann. §§ 39-17-501 et seq.). Torch sought a declaratory judgment affirming that its machines did not constitute "gambling devices" under the law, or alternatively, that the statutes were unconstitutionally vague. After reviewing testimony, exhibits, briefs, and arguments presented, the Court concluded that the NCGs qualify as illegal gambling devices and upheld the validity of the statutes.
