The three-judge panel will be composed of:
1. Chancellor JoeDae Jenkins, see Tenn. Sup. Ct. R. 54, § 3(b)(1), (d);
2. Judge Gary McKenzie, Middle Grand Division, see Tenn. Sup. Ct. R. 54, § 3(b)(2); and
3. Judge Deborah Stevens, Eastern Grand Division, see Tenn. Sup. Ct. R. 54 § 3(b)(2).
The case centered on the legality of Torch's "No Chance Games" (NCGs) in relation to Tennessee's criminal gambling statutes (Tenn. Code Ann. §§ 39-17-501 et seq.). Torch sought a declaratory judgment affirming that its machines did not constitute "gambling devices" under the law, or alternatively, that the statutes were unconstitutionally vague. After reviewing testimony, exhibits, briefs, and arguments presented, the Court concluded that the NCGs qualify as illegal gambling devices and upheld the validity of the statutes.
