SUPPLEMENT TO PETITIONER’S

OPPOSITION TO MOTION TO RESET EXECUTION DATE

Petitioner Abu-Ali Abdur’Rahman hereby supplements his Opposition to Motion to Reset Execution Date previously filed in this matter.

Petitioner hereby gives notice that he is today filing with the United States Supreme Court a Petition for Rehearing, pursuant to S. Ct. R. 44, in which he is requesting the Supreme Court to rehear his petitioner for a writ of certiorari which was initially granted and then subsequently dismissed by the Supreme Court.

Attached hereto is a letter dated December 10, 2002, issued by the Supreme Court to the Clerk of the United States Court of Appeals, Sixth Circuit, stating that the Supreme Court’s judgment in connection with its dismissal of the writ of certiorari “will issue after the expiration of 25 days from the date of the Opinion unless a timely petition for rehearing is filed.” Because Petitioner is filing a timely petition for rehearing, the Supreme Court’s judgment has not yet issued. See S. Ct. R. 45.

Accordingly, for these reasons, and for the reasons set forth in Petitoiner’s previously filed Opposition to Motion to Reset Execution Date, the Supreme Court’s stay of execution in this case remains in effect.
